Terms of Service

These Terms govern access to and use of the Italian forward-geocoding API and website operated under the qubitdata·geocoding brand at geocoding.qubitdata.it (the “Service”). By creating an account, requesting an API key, or making any request to the Service, you agree to be bound by these Terms.
1. Service description
The Service converts free-form Italian street addresses into coordinates, sourcing data primarily from Overture Maps and OpenStreetMap. Match quality is best-effort: returned coordinates are approximate and may carry confidence scores below 1.0. The Service is not a substitute for surveyed cadastral data or for any safety-critical positioning system.
2. Accounts and API keys
- You must provide a valid email address. Each account is issued one bearer API key on signup; the key is shown once and only its hash is stored.
- You are responsible for keeping your API key confidential. Treat it as a password.
- You are responsible for all activity under your key. Notify support@qubitdata.it immediately if you suspect compromise; we will rotate the key.
- One account per legal person or organisation.
3. Plans and pricing
- Free tier: 1,000 geocoding calls per calendar month, 10 requests per minute. No credit card required.
- Pay-as-you-go: €1 per 1,000 metered geocoding calls, billed monthly via Stripe in EUR. Counts are bucketised in increments of 1,000 (rounded up at month-end). 120 requests per minute.
- Enterprise: custom volume, SLAs, support — contact us.
- Prices are exclusive of any applicable VAT/IVA. Tax is handled at checkout via Stripe.
- We may change pricing with at least 30 days' written notice (email to your account address) before the change takes effect.
4. Billing, refunds, and cancellation
- Pay-as-you-go usage is metered server-side and reconciled with Stripe via meter events. You can review usage and invoices via the Stripe-hosted Customer Portal at /v1/portal.
- You may cancel your paid subscription at any time. Cancellation stops further metering at the end of the current billing period; calls already made within the period remain billable.
- Because the Service is metered usage already consumed, charges for past calls are non-refundable except where required by applicable consumer law.
- If a payment fails we may suspend the API key after a grace period; access resumes once the invoice is paid.
- You may set a monthly cap (in EUR) on your subscription; we will throttle or block requests once the cap is reached.
5. Acceptable use
- You may not resell raw API responses as a competing geocoding API. Caching geocoded results inside your own application is fine.
- You may not use the Service to infer the residence of a specific identified individual without a lawful basis under GDPR Art. 6.
- You may not attempt to bypass rate limits, quota controls, or authentication.
- You may not use the Service to facilitate illegal activity, harassment, or content that violates third-party rights.
- We may rate-limit, suspend, or terminate access for abuse, with refund of any unused prepaid balance where applicable.
6. Data sources and licensing
Address data is derived from Overture Maps (CDLA Permissive 2.0) and OpenStreetMap (ODbL 1.0). Re-distribution of large extracts of the raw underlying data is governed by those upstream licences. The Service's geocoded responses to your specific queries are provided to you under the terms in these Terms, with attribution preserved to upstream sources where required.
7. SLA, warranties, liability
- The Service is provided “as is” without warranty of any kind. No formal SLA is offered on the Free or Pay-as-you-go plans (Enterprise contracts may include one).
- We do not warrant uninterrupted availability or that returned coordinates are accurate to a specific tolerance.
- To the maximum extent permitted by applicable law, our aggregate liability for any claim arising under these Terms is capped at the greater of (i) €100 or (ii) the fees you paid us in the 12 months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, consequential, or special damages, including lost profits or revenue.
8. Privacy & sub-processors
We process personal data (account email, API request metadata, billing details) per our Privacy notice. Sub-processors:
- Cloudflare, Inc. — hosting, edge delivery, DDoS protection, Turnstile.
- Stripe Payments Europe, Ltd. — subscription billing, metered usage events, payment processing.
- Resend, Inc. — transactional email delivery (signup, billing notifications).
9. Termination
Either party may terminate the agreement at any time for any reason. On termination your account is closed, your API key is revoked, and we may delete account metadata after a 30-day grace period.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to your account address at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
11. Governing law and jurisdiction
These Terms are governed by the laws of Italy. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the competent courts of Italy, without prejudice to the consumer-protection rights you enjoy under the law of your country of residence.
